摘要：尽管中国已经批准了《经济、社会和文化权利国际公约》，但仍然有部分学者认为经济、社会和文化权利不是人权。为此，本文首先阐述了人权的性质和特征，并以此为基点，以Maurice Cranston为标靶，对否认经济、社会和文化权利人权性质的观点进行了批驳，并从正面论证经济、社会和文化权利保护了个人的关键利益，以论证其人权性质。
Abstract
Economic, social and culture rights are protected by International Covenant on Economic social and Cultural Rights, but some scholars, such as Maurice Cranston deny their human rights nature. The article expounds the nature and character of human rights and criticizes Maurice Cranston’s opinion. Then I argument that economic, social and culture rights protect the key interest of citizen, which help the poor to break away from the dilemma。
